Environmental Impact Assessment Process

The Department of Environment and Conservation (DEC) has introduced new procedures within its existing Environmental Impact Assessment Guidelines as shown below:

 

 

   
An application for any project, proposal or development activity is received with all relevant documents.
 
   
   
A Preliminary EIA is undertaken to determine whether or not a full EIA is necessary.
 
The particulars of the project are registered in the environmental Registry.
 

  EIA is required
 
 
 
 
EIA is not required however, conditions apply based on recommendations made by the DEC.
 
 

  EIA is not required with no conditions.
 
 
The DEC and EIA review committee establishes terms of reference (TOR) for requirements of EIA and refers it to project proponent, giving them 30 days for any comments.
 
     
Development proceeds and, regular compliance monitoring and inspection of environmental conditions is carried out by the DEC.
 
       
Proponents issue public notice concerning project proposal, inviting submissions from interested and relevant parties.
 
Consultations with all relevant stakeholders, custom landowners, chiefs and relevant parties are held.
 
EIA is carried out by a consultant registered with the DEC and resulting report is reviewed by the DEC and EIA Review Committee.
 
       
   
Minister considers recommendations and makes decision.
 

 
A 2nd consultation can be carried on the final report and, a final review is done by the Director and EIA Review Committee and recommendations are made to the Minister concerning the project proposal.
 
Application is rejected.
 
 
Application referred back to DEC for more information or a supplementary EIA Report.
 
 

  Application accepted with or without conditions and recommendations.
 
 
       
       
Development proceeds and, regular compliance monitoring and inspection of environmental conditions is carried out by the DEC.
